LeaseHawk, LLC (“LeaseHawk”, or “we”, “us”, or “our”, as applicable) values the privacy and personal information of our customers and partners. This Privacy Policy, as modified from time to time, describes our practices in connection with information collected through our www.leasehawk.com website (the “Website”), the LeaseHawk® CRM mobile application, related technologies and services, and any version thereof (collectively, the “Platform”).

As a general principle, information you provide to us will only be shared by LeaseHawk as outlined in this Privacy Policy. Our processing of such information shall be undertaken consistent with the requirements of applicable privacy laws.  Whether we serve as the data controller or processor, we have implemented numerous technical and organizational measures to ensure the protection of personal information processed through the Platform.  However, Internet-based data transmissions may in principle have security gaps, so please understand that absolute protection is not assured.

By visiting or using the Platform, you accept and expressly agree to the practices and policies set forth in this Privacy Policy.  If you do not agree to the terms of this Privacy Policy, you cannot, and we do not authorize you to, access, browse, or use the Platform.

As noted below under “Changes to Privacy Policy”, we reserve the right to amend this Privacy Policy from time to time in our sole discretion, and will post and maintain the most recent version of the Privacy Policy on the Website. We may not notify Platform users of any such amendments and you are responsible for reviewing this Privacy Policy upon each visit to the Website or use of the Platform, including without limitation any mobile application, referring to the “Last Modified” date at the top of this document to verify any changes since your last visit.

  1. Information We Collect

We collect two basic types of information from you in conjunction with your use of the Platform – personal information and non-personal information. “Personal information” is any information that can individually identify you or your customers and includes, for example and without limitation, your or your customer’s name, email address, username, telephone number, postal address, payment card, billing and contact information, etc.  “Non-personal information” includes information that does not personally identify you or your customers, but may include, for example and without limitation, tracking and usage information about your location, demographics, transaction information, use of the Platform and the Internet, etc.  Any one or more of these items of information may be collected through the Website and/or the Platform, depending on your use.

Personal Information

There are a number of circumstances in which you may voluntarily supply us with personal information. The following lists the most common ways in which we may collect personal information:

  • Registering for an account on the Platform
  • Providing customer or other third party information through the Platform
  • Signing up to receive information or related services from us via Website or Platform
  • Requests for customer service or other assistance
  • Participation in surveys, special events, contests, sweepstakes, and promotions
  • Any other place on the Website or Platform where you knowingly volunteer personal information

You may still access and use some portions of the Platform if you choose not to provide us with any personal information, but features of the Platform that require your personal information will not be accessible to you.

Non-Personal Information

When you use the Website and/or Platform, our servers may keep an activity log that does not identify you individually. These logs may include information such as device information about your computer, mobile device, or other device that you use to access the Website and/or Platform, which may include your IP address, browser, etc., your search terms and selections and search results, and additional traffic data, such as time and date of access, access times, and referring website addresses.  We use this information to assist us in running the Website and Platform and to ensure proper operation.

Social Media Sites

When you interact with the Website and/or Platform on a social media platform, such as Facebook, Twitter, Tumblr, Pinterest, Instagram, and the like, we may collect the personal information that you make available to us on that page or account, including your user ID and/or user name, and any information you have made public in connection with that social media service.  Please note, however, that we will comply with the privacy policies of the corresponding social media platform and we will only collect and store such personal information that we are permitted to collect by these social media platforms. By linking a social media account to your account on the Platform, you represent that you are authorized to provide any Personal Information accessible thereby to LeaseHawk.

Use of Cookies and Tracking Technologies

When you interact with the Website, we automatically receive and record information on our server logs from your browser, including your IP address, “cookie” information, and the page you requested.

Cookies and other tracking technologies (such as browser cookies, pixels, beacons, and Adobe Flash technology including cookies) are comprised of small bits of data that often include a de-identified or anonymous unique identifier.  Websites, platforms, portals, apps and other services send this data to your browser when you first request a web page and then store the data on your computer so the website can access information when you make subsequent requests for pages from that service. We may use these technologies to also collect and store information about your usage of the Website, such as the pages you have visited, content you have viewed, search queries you have run and advertisements you have seen.

Most browsers are initially set to accept cookies, but you can change your settings to notify you when a cookie is being set or updated, or to block cookies altogether. Please consult the “Help” section of your browser for more information. By using the Website, you consent to the use of cookies in connection with the operation of the Website as described above.

“Do Not Track” Practices

At this time, we do not honor do-not-track signals from browsers or other consumer choice mechanisms regarding the collection of behavioral tracking data. While we collect personal information from you as described above, we do not collect personal information from you to monitor your online activities across third party websites or online services and over time (also known as behavioral advertising or interest-based advertising).  We do not use or allow third parties to collect personal information from you on the Website or Platform in order to monitor your online activities across third party websites or online services and over time.

Children’s Online Privacy

LeaseHawk is committed to complying with the Children’s Online Privacy Protection Act (COPPA).  LeaseHawk requires you to be at least 18 years old to use the Platform.  We do not knowingly solicit, collect, utilize, or disclose Personal Information from minors.  If we learn that a minor has provided Personal Information to us, we will use that information only to respond directly to that minor (or his/her parent or legal guardian) to inform the child that he/she cannot use the Platform, and we will take commercially reasonable steps to delete that information.

Email and Other Communications

We may contact you by email or other means at an email address that you have provided to us. For example, we may send you promotional offers or our newsletter. If you do not want to receive email from us, please let us know through the “unsubscribe” feature included in our communications.

  1. Our Use of Information

We use the information we collect from you and about you to help us personalize and continually improve your experience with the Website and/or Platform. Additionally, we may use the information we collect from and about you in the following ways:

  • Provide you with the products and services you request from us
  • Communicate with you about your account or transactions with us and send you information about features on the Platform
  • Communicate with you about changes to our policies
  • Perform statistical, demographic, and marketing analyses of users of the Platform and their usage patterns
  • Send you newsletters, offers, and promotions for our products and services by email or other media
  • Optimize or improve our products, services, and operations
  • LeaseHawk may use the property and/or main contact information associated with your account to contact you and/or other representatives of your company for purposes including but not limited to, support of the Platform, to gather feedback regarding the Platform and to make and/or send marketing and/or sales communications on occasion for other products or services offered by LeaseHawk or LeaseHawk’s partners
  • LeaseHawk, or its authorized agents, may on occasion contact the individuals communicating with you via the Platform directly in order to provide support, assist with trouble-shooting or gather feedback that could be used to improve the Platform
  • LeaseHawk may use aggregated data regarding users and any usage of the Platform, including but not limited to, the communications occurring via the Platform and leasing outcome, for marketing or promotional purposes
  • LeaseHawk may share aggregated data with our partners as it relates to overall Platform usage even if such usage includes information related to contacts that did not utilize the partner’s service

We will only share personal information as provided in this Privacy Policy, and within LeaseHawk and our corporate affiliates.

As part of using and/or accessing the Website and/or Platform, we may share your Personal Information and/or Non-Personal Information with third party companies and individuals to facilitate or provide services in connection with the Platform, to provide customer support, to perform website and mobile application-related services (e.g., without limitation, maintenance services, database management, web analytics and improvement of Platform features) or to assist us in analyzing how the Platform is used.

Emergency Situations

LeaseHawk will abide by the United States of America data privacy laws.  We may use or disclose your personal information if required to do so by law or in the good-faith belief that such action is necessary to (a) conform to applicable law or comply with legal process served on us or the Platform; (b) respond to requests from public and government authorities; (c) protect and defend our rights or property, the Platform, or our users; and (d) act under emergency circumstances to protect the personal safety of us, our affiliates, agents, or the users of the Platform or the public.

Merger, Sale, Or Bankruptcy

If we sell all or part of our business, or make a sale or transfer of our assets, or are otherwise involved in a merger or transfer of all or a material part of our business, or are involved in a bankruptcy, LeaseHawk may transfer your Personal Information and Non-Personal Information to the party or parties involved as part of that transaction.

De-identified and Aggregate Information

We may disclose information that is neither personal information and/or has been de-identified and/or aggregated at our discretion.

California and Nevada Disclosures

If you are a California resident, you have certain rights over your Personal Information held by LeaseHawk under the California Consumer Privacy Act (the “CCPA”). California residents are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. If you are a Nevada resident, you have the right to opt-out of the sale of your personal information collected by us through the Platform.

You can request access to, or deletion of, your personal information that we collect and maintain through our Services by contacting us at support@leasehawk.com or call us at (800) 485-8430 with “Request for Privacy Information” on the subject line and in the body of your message.  We will provide the requested information to you at your e-mail address in response. Whichever way you elect to contact us, we may ask that you confirm and verify your identity.

  1. Security and Retention

We are concerned about ensuring the security of your personal information.  In connection with your use of the Website and/or Platform, your Personal Information and Non-Personal Information are collected and stored in secured databases and servers.  We use industry-wide, standard, commercially reasonable efforts to protect your Personal Information collected through the Platform from access, loss, misuse, alteration, or destruction by any unauthorized party. Due to the nature of security practices (there is no 100% secured platform available in the industry), we cannot guarantee the security of our databases, nor can we guarantee that information you supply in connection with use of the Website and/or Platform will not be intercepted while being transmitted to us over the Internet or wireless communication.  Therefore, any information you transmit to the Website or Platform is at your own risk. We do not promise, and you should not expect, that your personal information or private communications will always remain private.

We retain personal information about you for as long as necessary to provide you the Platform.  In some cases, we retain personal information for longer, if doing so is necessary to operate and improve our Platform services, comply with our legal obligations, resolve disputes or collect fees owed, prevent fraud, enforce the Privacy Policy, or as otherwise permitted or required by applicable law, rule or regulation.  Afterwards, we retain some information in a depersonalized or aggregated form but not in a way that would identify you personally.

Please note that the Website and/or Platform may link to other websites and online services operated by third parties. You may have arrived at the Platform from, or began your use of the Platform at, a third party web service, including a third party web service that links to the Platform or embeds LeaseHawk content.  The presence of such links or content on third party web services does not mean that we endorse that web service, the quality or accuracy of information presented on the non-LeaseHawk web service or the persons or entities associated with the non-LeaseHawk web service.  These websites and applications operate independently from us, and we do not control their privacy policies, which may be different from ours. We encourage you to review the privacy policies of any third-party websites or applications.  If you decide to visit a third party web service, you are subject to the privacy policy of the applicable third party web service and LeaseHawk is not responsible for the content or policies of any third-party services. In addition, the policies and practices of third parties do not apply to your information, including personal information, obtained pursuant to this Privacy Policy.

  1. Indemnification

You will indemnify, defend, and hold us, our affiliates, officers, directors, employees, consultants, agents, representatives, successors, and assigns harmless from and against any and all claims, damages, losses, liabilities, costs and expenses (including without limitation reasonable attorneys’ fees and court costs) (collectively, “Losses”) that constitute, or arise out of or in connection with your negligent acts or omissions or willful misconduct, including, without limitation, a breach or mishandling in the Website and/or Platform leading to the dissemination of any LeaseHawk or other third party’s confidential or private information.  These defense and indemnification obligations will survive this Privacy Policy and your use of the Website and/or Platform.  We have no obligation whatsoever to indemnify, defend, or hold you harmless from any Losses resulting from, relating to, or arising out of, this Privacy Policy or the Platform.

  1. Notice to Non-US Users

As the Internet is a global environment, collecting and processing Personal Information may involve the transmission of this data internationally, including into and/or outside of the United States.  Therefore, by communicating electronically with us you acknowledge and agree to your personal data being processed in this way.

Specifically, if you are located outside of the United States, please be aware that by using the Platform your personal information may be transferred to the United States, the privacy laws of which may be deemed by your country to have inadequate data protection. If you are located outside of the United States and voluntarily submit personal information to us, you thereby consent to the general use of such information as provided in this Privacy Policy and to the transfer of that information to, and/or storage of that information in, the United States.  Nevertheless, our Platform is intended for users only within the United States.

As noted in the beginning of this Privacy Policy, we reserve the right to amend this Privacy Policy from time to time in our sole discretion, and will post and maintain the most recent version of the Privacy Policy on the Website.  Your continued use of the Platform after the effective date constitutes your acceptance of the amended Privacy Policy.  We may not notify Platform visitors of any such amendments by e-mail or other personal contact.  You are responsible for reviewing this Privacy Policy upon each visit to the Website or use of the Platform.
